Terms of Service

1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the VAERION platform, website, and related services (collectively, the "Service") operated by VAERION Systems ("VAERION," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not access or use the Service.
2. Eligibility
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
3. Account Registration
To request access to the VAERION platform, you must submit accurate and complete information including your name, email address, phone number, and business name. You are responsible for maintaining the confidentiality of any account credentials and for all activity that occurs under your account.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Infringe the intellectual property or privacy rights of others
- Transmit malicious code, spam, or unauthorized automated requests
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the integrity or performance of the Service
5. Intellectual Property
The Service and all associated content, features, and functionality are owned by VAERION Systems and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.
6. SMS Program Terms
Message Types:
By opting in to receive SMS text messages from VAERION, you may receive messages related to: platform access notifications, onboarding updates, appointment reminders, and account/service alerts. If you separately opt in to receive promotional SMS messages, you may also receive: product updates, feature announcements, tips, and special offers.
Opt-Out:
You can opt out of receiving SMS messages at any time by replying STOP to any message from VAERION. After opting out, you will receive a one-time confirmation message and no further SMS messages will be sent unless you re-subscribe.
Help:
For help with SMS messaging, reply HELP to any message from VAERION, or contact us at contact@vaerionsystems.com.
Supported Carriers:
The VAERION SMS Program is supported on major U.S. carriers. Carriers are not liable for delayed or undelivered messages.
7. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VAERION Systems SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF YOUR USE OF THE SERVICE.
9. Termination
We may suspend or terminate your access to the Service at any time, with or without cause or notice. Upon termination, your right to use the Service will immediately cease.
10. Changes to Terms
We may update these Terms from time to time. If we make material changes, we will notify you by updating the effective date at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
